Terms of Use for Textbook Technology online stores and services

These Terms of Service (“Terms”) govern your access to and use of the websites, online stores, mobile features, and related services (collectively, the “Site” and “Services”) operated by Textbook Technology, Inc., doing business as Textbook Brokers, Campus Bookstore, and affiliated campus stores (“we,” “us,” or “our”). By accessing or using the Site, creating an account, or placing an order, you (“you” or the “customer”) agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site or Services.

1. Eligibility and Accounts

You must be able to form a legally binding contract to use the Services. If you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

2. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not:

  • Use the Site in any way that violates applicable law or regulation;

  • Attempt to gain unauthorized access to any part of the Site, other accounts, or our systems or networks;

  • Interfere with or disrupt the integrity or performance of the Site, including by introducing malware or excessive automated requests (scraping, crawling, or similar) without our permission;

  • Misrepresent your identity or affiliation; or

  • Use the Site to infringe the intellectual property or other rights of any party.

3. Orders, Pricing, and Availability

All orders are offers to purchase and are subject to our acceptance. We may limit, cancel, or refuse any order, including where product is unavailable, where there is an error in price or product information, or where we suspect fraud. Prices, promotions, and availability are subject to change without notice. In the event of a pricing or description error, we may cancel or correct the affected order and refund any amount charged. You are responsible for applicable taxes and any shipping charges disclosed at checkout.

4. Course Materials, Rentals, and Digital Content

Textbooks and course materials may be offered for purchase, rental, or as digital content (eBooks and courseware). Rentals are subject to the applicable rental period, return-by dates, condition requirements, and non-return or damage fees disclosed at the time of rental. Digital content is licensed, not sold, and is subject to the access terms and any restrictions of the applicable publisher or provider. Specific product, rental, shipping, and return details are described in the Help Center and the Refund & Return Policy, which form part of these Terms.

5. Shipping, Pickup, Returns, and Refunds

Shipping, in-store pickup, order processing, returns, and refunds are governed by the policies published in our Help Center, including the Refund & Return Policy. Please review those policies before ordering; they are incorporated into these Terms by reference.

6. Payments

Payments are processed through third-party, PCI-DSS-compliant payment processors. By submitting payment information, you authorize us and our processors to charge your selected payment method for the total order amount, including taxes and shipping. We do not store full payment card numbers; card data is handled by the payment processor. Where campus-card or financial-aid tender is supported, additional institutional terms may apply.

7. Intellectual Property

The Site and its content — including text, graphics, logos, and software — are owned by us or our licensors and are protected by intellectual-property laws. University names, logos, and trademarks are used under license from the applicable institution and remain the property of their owners. You may not copy, reproduce, distribute, or create derivative works from the Site or its content without our prior written permission, except as necessary to use the Services for their intended purpose.

8. Text Messaging and Communications

If you opt in to our text-messaging program, your participation is governed by our SMS/Mobile Terms and our Privacy Policy. Message and data rates may apply; you may opt out at any time as described in those terms. By providing contact information, you consent to receive service-related communications about your orders and account.

9. Third-Party Links and Services

The Site may link to or integrate third-party websites and services (for example, payment processors, shipping carriers, and content providers). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their terms.

10. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Textbook Technology, Inc., its affiliates, and their respective personnel from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted, and the “Effective date” above will be updated. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Arkansas will have jurisdiction over any dispute arising from these Terms or your use of the Services, and you consent to venue in those courts.
